LADIES FIRST FITNESS CLOSES IN LYNCHBURG; ELIGIBLE MEMBERS MUST FILE FOR REFUNDS BY APRIL 15, 2012

The Virginia Department of Agriculture and Consumer Services (VDACS) is advising consumers that Ladies First Fitness, located at 3412 Waterlick Road, Suite R, in Lynchburg, Virginia, closed as of December 31, 2011. Eligible members of this health spa who believe they are due refunds have until April 15, 2012, to file a claim with VDACS’ Office of Consumer Affairs (OCA).

The Virginia Health Spa Act (Act) provides that when a health spa facility goes out of business and cannot provide membership at a comparable alternate facility, all contracts are cancelled automatically and eligible members are entitled to receive a prorated refund of the unexpired portion of their contract. Ladies First Fitness did not have a comparable alternate facility and all of its contracts have been cancelled. Ladies First Fitness also informed OCA that it is unable to make refunds to eligible members. Therefore, OCA will be issuing prorated refunds to eligible members from the surety filed with that office by Ladies First Fitness.

Members who believe they are due refunds should contact OCA to file a claim. Members must establish eligibility for a refund by submitting a copy of their contract, proof of payment and a completed Health Spa Refund Request form.
