FITNESS 1440 IN NORFOLK CLOSES; ELIGIBLE MEMBERS MUST FILE FOR REFUNDS BY NOVEMBER 6, 2013

The Virginia Department of Agriculture and Consumer Services (VDACS) is advising consumers that Fitness 1440, a health club facility located at 122 East Little Creek Road, Norfolk, Virginia, closed as of July 1, 2013. Members of this particular health club who have prepaid contracts that had not expired at the time the facility closed have until November 6, 2013, to file a claim for refund with VDACS.
The Virginia Health Spa Act (Act) provides, in part, that members of a health club may cancel their membership contract if the facility relocates or goes out of business and the health club fails to provide comparable alternate facilities within five driving miles of the location designated in the health club contract. Upon cancellation of the contract, eligible members are entitled to receive a refund of the unexpired, paid portion of their contract. Fitness 1440 did not have a comparable alternate facility; therefore, eligible members may file a claim with VDACS in order to establish refund eligibility.
To establish eligibility, members must submit a copy of their contract, proof of payment and a completed Health Club Complaint form. This form is available on VDACS’ website at www.vdacs.virginia.gov. Select “Special Programs and Quick Links,” then “Forms.” Scroll down to forms for the Division of Consumer Protection and select the “Health Club Complaint Form.”
