Fitness Advantage in the City of Norton, VA, Closes; Eligible Members Must File for Refunds by October 20, 2022

The Virginia Department of Agriculture and Consumer Services (VDACS) is reporting that Fitness Advantage, LLC., dba Fitness Advantage, a health club located at 925 Park Avenue NW, Norton, VA, closed its doors to members on or around May 28, 2022. Eligible members of this health club, who believe they might be due a refund of their membership contract, can submit a claim to VDACS. Claims must be postmarked by October 20, 2022.

The Virginia Health Club Act (VHCA) specifies that if a health club goes out of business and does not provide its members with comparable alternate facilities within five driving miles of the location designated in the health club contract, all contracts are automatically canceled and eligible members are entitled to receive a prorated refund of the unexpired portion of the contract.

According to the VHCA, it is the responsibility of the health club to issue refunds to eligible members within 30 days of the closure of the club. The VHCA also requires certain health clubs to file surety with VDACS’ Office of Charitable and Regulatory Programs (OCRP) to protect consumers in the event that a club closes and is unable to make refunds to its members.

The closed Fitness Advantage in Norton is unable to issue refunds. Therefore, OCRP will issue prorated refunds to eligible members for the unexpired portion of their contracts from the surety on file.

Members who believe they are due refunds should contact OCRP to file for any refund due. Members must establish eligibility for a refund by submitting a copy of their contract, proof of payment, and a completed OCRP Health Club Complaint Form.
